Victoria & Atlas — Terms of Use

Victoria & Atlas is designed for children and the grown-ups who care for them.

Children should use Victoria & Atlas with the involvement and supervision of a parent, guardian, educator, or other responsible adult when appropriate.

Certain features, including account management, purchases, subscriptions, external links, personalization settings, and privacy controls, may be restricted to adults.

Parents and guardians are responsible for determining whether Victoria & Atlas and its content are appropriate for their child.

Where the Service allows information about a child to be entered, parents and guardians should provide that information themselves.

Children should not independently provide personal information unless a particular feature specifically permits it and appropriate safeguards are provided.

Victoria & Atlas is a fictional story universe.

Stories may explore themes including courage, kindness, friendship, curiosity, imagination, emotions, growing up, family relationships, new experiences, and everyday childhood challenges.

Our stories, activities, and other content are intended for entertainment, literacy, creativity, family connection, and general educational purposes.

They are not medical, psychological, behavioral, therapeutic, diagnostic, or other professional advice.

Bright Nest Play retains editorial and creative control over Victoria & Atlas, including its characters, stories, illustrations, narration, activities, educational materials, themes, vocabulary, world-building, personalization options, and generated content.

We may establish, modify, limit, reject, or discontinue particular character attributes, personalization choices, themes, story topics, visual styles, vocabulary, or other content options.

Submitting a personalization request does not guarantee that a requested characteristic, scenario, theme, or other content will be generated or included.

Victoria & Atlas may offer optional features allowing a parent or guardian to personalize certain experiences using information such as a child’s name or nickname, age or age range, selected character characteristics, interests, feelings, situations, favorite characters, or adventure preferences.

Available personalization choices are determined by Bright Nest Play and may be limited to the character templates, story structures, classifications, visual styles, vocabulary, themes, and other creative options supported by the Service.

Bright Nest Play does not represent that its personalization options reflect every family structure, identity, belief, lifestyle, cultural preference, or individual characteristic.

The inclusion or absence of a particular personalization option should not be interpreted as a statement by Bright Nest Play regarding any individual, family, identity, belief, or way of life.

Parents and guardians are responsible for selecting the available options they consider appropriate for their family.

If the available options do not meet a family’s preferences or needs, the family may choose not to use the personalization feature or Service.

Certain personalized experiences may use predefined character templates and characteristics, including boy and girl character options.

These options are part of the creative and technical framework of the Victoria & Atlas experience and are not intended to express a judgment about any individual, family, identity, belief, or way of life.

Bright Nest Play does not represent that every possible character attribute, classification, identity, or personalization option will be available.

Bright Nest Play retains discretion over which character templates and personalization options the Service supports.

Certain Victoria & Atlas features may use artificial intelligence, automated systems, or related technologies to assist in creating personalized stories, illustrations, recommendations, narration, activities, or other experiences.

AI-assisted content may occasionally contain errors, inconsistencies, unexpected results, or content that does not perfectly reflect information provided by a parent or guardian.

Bright Nest Play may review, filter, modify, reject, regenerate, restrict, or remove generated content to maintain child safety, age appropriateness, creative consistency, intellectual-property protections, and Victoria & Atlas content standards.

Parents and guardians should review personalized content when appropriate before presenting it to a child.

Users may not intentionally use personalization or content-generation features to create or request content that is:

• unlawful
• sexually explicit or exploitative
• abusive or threatening
• hateful or discriminatory
• excessively violent
• dangerous or encouraging dangerous conduct
• invasive of another person’s privacy
• infringing upon another person’s intellectual-property rights
• otherwise inappropriate for a children’s service

Bright Nest Play may refuse, restrict, or remove requests or generated content inconsistent with these standards.

Adult users may be permitted to create family accounts and child profiles.

Parents and guardians are responsible for maintaining the confidentiality of their account credentials and for activity conducted through their accounts.

Child profiles should be created and managed by a parent or guardian.

Parents and guardians should provide only the information reasonably necessary to use the requested feature.

Certain stories, activities, personalization features, audio experiences, or other content may require a paid membership or separate purchase.

Prices and included features will be presented before purchase.

Subscriptions may automatically renew when disclosed at the time of purchase unless canceled according to the applicable subscription terms.

Purchases processed through Apple, Google, Stripe, or another payment provider may also be subject to that provider’s terms and policies.

Victoria & Atlas and its characters, stories, artwork, illustrations, logos, names, worlds, keepsakes, audio, activities, designs, software, and other original content are owned by or licensed to Bright Nest Play LLC and are protected by applicable intellectual-property laws.

Your access to Victoria & Atlas provides you with a limited, personal, non-exclusive, non-transferable right to use the Service for personal and family purposes.

It does not transfer ownership of Victoria & Atlas intellectual property to you.

Personalized content may combine information provided by you with intellectual property belonging to Bright Nest Play.

Providing a child’s name, interests, preferences, or other personalization information does not give Bright Nest Play ownership of those underlying personal facts.

However, Victoria & Atlas characters, artwork, templates, story structures, worlds, designs, systems, and other proprietary elements incorporated into personalized content remain the property of Bright Nest Play or its licensors.

Schools, educators, childcare providers, and other institutions may use Victoria & Atlas only in accordance with applicable account, license, educator, or institutional terms.

Separate agreements may apply to classroom or institutional use.

Bright Nest Play may add, modify, remove, restrict, or discontinue features, stories, activities, memberships, characters, personalization options, or other portions of the Service.

We do not guarantee that any particular feature or content will remain available indefinitely.

Victoria & Atlas is provided on an “as available” basis to the extent permitted by law.

Although we work to create safe, thoughtful, and age-appropriate experiences, we cannot guarantee that every child or family will consider every story, activity, theme, or personalized experience appropriate for their individual circumstances.

Parents and guardians remain responsible for determining what is appropriate for their children.

To the maximum extent permitted by applicable law, Bright Nest Play LLC and its owners, employees, contractors, partners, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to use of the Service.

Nothing in these Terms limits rights or remedies that cannot legally be limited or excluded.

Bright Nest Play may suspend or terminate access when we reasonably believe an account:

• violates these Terms
• is being used unlawfully
• threatens child safety
• infringes intellectual-property rights
• abuses personalization or generation systems
• threatens the security or integrity of the Service

Users may stop using Victoria & Atlas at any time.

We may update these Terms as Victoria & Atlas evolves.

When required by applicable law, we will provide notice of material changes.

The “Last Updated” date at the top of these Terms identifies the most recent revision.

These Terms are governed by applicable law and, where legally permitted, the laws of the State of Texas, without regard to conflict-of-law principles.
